The American Commodity Futures Trading Federation (CFTC) promised to supervise crypto tokens not belonging to securities at a meeting on February 3.

Rostin Behnam, the current chairman of CFTC, expounded the position of the regulatory organization at the winter meeting of the ABA Commercial Law Unit Derivatives and Futures Trading Legal Committee.

There, Benham showed that the regulatory space for encryption is higher. He said:

"There is still a gap in the regulation of non-security tokens in the crypto financial market. I firmly believe that CFTC will be able to fill this gap if selected by the Congress."

Benham indicated that CFTC would touch the latest meeting of Congress and achieve this overall goal. The 118th session of the United States Congress was gradually held on Friday and will continue for two years until February 3, 2025. It maintains the majority of the Democratic Party's House of Lords, but introduces the majority of the US Democratic Party's House of Representatives - which will seriously affect the interaction between the CFTC and due process.

Benham described all kinds of bankruptcies and crashes in 2022, and said that it was necessary to regulate to maintain users and limit failures.

Next, he described CFTC's diligence in the field of encryption. Benham stressed that the compliance management branch of CFTC has requested the crypto derivatives service platform to confirm its compliance. He added that CFTC held meetings with the registration platform on time. He also said that one unit of CFTC was trying to determine whether some channels for buying and selling crypto derivatives should implement trading limits for employees.

Benham also described the actual cases of CFTC in the past year, including typical cases of milestones for OokiDAO, and cases for FTX and Alameda Research.

He stressed that up to now, CFTC has clearly put forward 69 lawsuits involving digital currency, and added that cases involving digital currency accounted for 20% of the 82 lawsuits filed by regulatory organizations last year. He said this conclusion was "excellent" because CFTC's "rights are very limited"

The role of CFTC in encryption regulation is now lower than that of the United States Securities and Exchange Commission (SEC). The SEC dominates this industry because many new encryption projects can be called securities. The SEC often penalizes crypto trading centers, online loan platforms, token marketing and sales, and takes action to crack down on fraud.

The development trend of the situation in the last year shows that CFTC may play a greater role in encryption supervision. Gary Gensler, the current chairman of the SEC, also supported granting more personas to CFTC.
